Well you could probably just split the video in two in post.
This wouldn't really help the LPers any. They'd still be creating and posting videos of copyrighted game-play. Whether they're talking over it or not doesn't really affect video game companies' legal rights over the material.

The idea is that they'd monetize the commentary but not the gameplay footage, and the vid with the commentary on it would just be like a static splash screen or something.
But as I pointed out above, having half of your vids monetized by someone else makes getting a partnership pretty tricky. Also it's just mad inconvenient.
So the route most people have taken is to simply not cover Nintendo games anymore. I'm not sure what the more diehard Nintendo LPers like Chuggaaconroy etc. are doing, though, offhand.

OK, yes, that would be legal and roughly what Rifftrax is doing, minus the benefit that producing the film they're riffing over is the viewers/listeners problem.

I am avoiding buying Nintendo-made games, though not necessarily Nintendo-published ones (Gamefreak has done nothing wrong).
Still I think it's more a thing on the LPers' side.
