to be fair, I think that's because he's Swedish, and Sweden has a maximum of 21 years for prison sentences, whereas in the USA they can and will lock you up indefinitely.
That's at least partly because Sweden has a criminal justice system that recognises that sticking people in jail for the rest of their lives is generally a really bad idea. There's also the fact that black metal is a niche genre with some really weird cultural aspects to it. I should also point out that Vikernes is less an immortal legend than a notorious nutter-butter whose music happens to be well-respected among certain fans.
Granted, you might have been intentionally making a faulty comparison for the sake of sarcasm, but it's a faulty comparison either way...
