It usually refers to some sort of type of legally recognized divisions, as opposed to some sort war where people fight it using specific "civil" rules, A la G Gundum.

It certainly cuts down in the horrors of war. I'd imagine it wouldn't hold in modern reality with entire groups of people falling under sway simply because they're champion wasn't up to snuff, especially if they're a significantly larger and/or stronger group then the winner's side.
Duels in war did occasionally happen in ancient times. Such as the Spring in Autumn period in China, or something like David vs Goliath, or the various [[http://en.wikipedia.org/wiki/Hector#Duels_with_warriors Duels of Hector]]. Though, they where never to completely decide the battle. Only to boost morale/strike fear or by time to do something else for the battle.

The root of "civil" is "city", not "polite". Heck, the root of "polite" is "city" (polis) too.
